Mediation Services
McNamara Law Firm offers private mediation services for business and commercial disputes throughout Omaha, West Omaha, and across Nebraska. These services are designed primarily for attorneys and their clients seeking an efficient, professional, and neutral forum to resolve disputes outside of court.
Mediation is often the fastest and most cost-effective way to bring a business dispute to resolution. Our approach emphasizes preparation, efficiency, and practical problem-solving—without unnecessary formality or theatrics.
Practice Focus
Mediation services are available for a wide range of business and commercial matters, including:
Contract and payment disputes
Construction and development disagreements
Partnership, shareholder, and LLC member disputes
Commercial real estate and lease issues
Employment and separation-related business disputes
Vendor, supplier, and service-provider conflicts
These mediations are not family, domestic, parenting, or harm-related matters and are limited to civil and commercial disputes.
Approach
As a mediator, Patrick McNamara serves as a neutral facilitator, not as legal counsel for either party. The focus is on helping the parties and their attorneys identify risks, evaluate options, and reach workable resolutions efficiently.
Mediations are structured, prepared, and attorney-friendly, while remaining flexible enough to adapt to the needs of the dispute. The goal is to move matters toward resolution without unnecessary delay or expense.
Key principles include:
Efficiency: Focused sessions with clear expectations and preparation
Approachability: Direct, practical engagement with counsel and parties
Experience: Informed by years of litigation, negotiation, and mediation experience
Mediation Format & Logistics
Mediations may be conducted:
In person at McNamara Law Firm’s offices (multiple conference rooms available)
Virtually via Zoom
At another agreed location, if appropriate
Sessions may be scheduled as:
Half-day mediations, or
Full-day mediations, depending on the needs of the case
Pre-Mediation Submissions
To ensure productive sessions, the following are required prior to mediation:
A mediation statement shared with all parties, and
A separate confidential statement submitted solely for the mediator’s review
These submissions allow the mediation session to begin with a clear understanding of the issues, positions, and practical considerations driving the dispute.
